NY - Sen. Liz Krueger (D-26) introduced S.B. 2855, which would require manufacturers of prescription drugs to report their annual marketing costs to the department of health. S.B. 2855 defines “marketing” as “advertising and promotional activities for prescription drugs dispensed in this state” “with regard to all providers of healthcare services… including health maintenance organizations”, including “all expenses associated with food, entertainment and gifts valued at more than seventy-five dollars, and anything provided to a health care professional for less than market value.”

Given that incentives for health care providers participating in marketing research studies could be included, MRA will seek to amend or defeat S.B. 2855.
